01. Agreement to Terms

By accessing SwiftThumbnail (the "Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. These terms apply to all users, including affiliates and subscribers.

Service Provider: SwiftThumbnail is operated by ysfik, a sole proprietorship based in Indonesia, Jawa Tengah.

02. Eligibility

You must be at least 18 years old to use SwiftThumbnail. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

03. Account Registration

To access certain features, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and current information

We reserve the right to suspend or terminate accounts that violate these Terms.

04. Subscriptions & Payments

SwiftThumbnail operates on a credit-based subscription model. Payments are processed securely through Whop.

• Trial Period: New users receive a $1 trial for the first 3 days, then standard pricing applies
• Billing Cycle: Subscriptions renew monthly unless cancelled
• Price Changes: We reserve the right to modify pricing with 30 days notice
• Cancellation: You may cancel anytime; access continues until the end of your billing period

05. Content Ownership & License

Your Content: You retain 100% ownership and commercial rights to all thumbnails generated through SwiftThumbnail. You may use, modify, and distribute generated content without restriction.

Our Technology: The underlying AI models, algorithms, and platform infrastructure remain the exclusive property of SwiftThumbnail. You may not reverse-engineer, copy, or redistribute our technology.

Input Content: You grant us a limited license to process your uploaded images and prompts solely for the purpose of generating thumbnails. We do not use your inputs to train public AI models without explicit consent.

06. Prohibited Uses

You may NOT use SwiftThumbnail to create or distribute content that:

• Adult/Sexual Content: Pornography, nudity, or sexually explicit material
• Illegal Content: Violates any applicable laws or regulations
• Hate Speech: Promotes violence, discrimination, or hatred based on race, religion, gender, etc.
• Impersonation: Deepfakes or misleading content impersonating real individuals without consent
• Copyright Infringement: Uses copyrighted material without proper authorization
• Spam/Abuse: Automated scraping, bot activity, or platform abuse

Political Content: Allowed, but you are solely responsible for compliance with election laws and regulations in your jurisdiction.

Violation of these restrictions may result in immediate account termination without refund.

07. Usage Limits

Service usage is metered via a credit system. Each subscription tier includes a monthly credit allocation. Credits reset at the beginning of each billing cycle and do not roll over. Excessive usage or abuse may result in rate limiting or account suspension.

08. Affiliate Program

SwiftThumbnail offers an affiliate program allowing users to earn commissions by referring new customers.

Commission Structure:

• 20% commission on all payments (including trial and subscription fees)
• Commission period: 12 months from the date you join the affiliate program
• Minimum payout: $50 USD
• Payment method: PayPal only
• Payout processing: Within 5-7 business days of request

Affiliate Responsibilities:

• Disclose affiliate relationship when promoting SwiftThumbnail
• Comply with FTC guidelines and applicable advertising laws
• Use ethical marketing practices (no spam, false claims, or misleading content)
• Not bid on SwiftThumbnail trademarks in paid search campaigns

Termination & Fraud:

• We reserve the right to terminate any affiliate account at any time for any reason
• Fraudulent activity (fake signups, self-referrals, bot traffic) results in immediate termination and forfeiture of all commissions
• Commission disputes are resolved at our sole discretion
• Unpaid commissions may be forfeited upon termination for cause

Cookie Window: Referral tracking uses a 30-day cookie. If a referred user signs up within 30 days of clicking your link, you receive credit for the referral.

09. Service Availability

SwiftThumbnail is provided "as is" without guarantees of uptime or availability. We strive for 99.9% uptime but are not liable for service interruptions, maintenance downtime, or technical issues. We reserve the right to modify, suspend, or discontinue any feature at any time.

10. Limitation of Liability

To the maximum extent permitted by law, SwiftThumbnail and its operators shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from service interruptions or data loss
• Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless SwiftThumbnail, its operators, and affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or distribute using our Service

12. Termination

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Abuse of the Service or other users

Upon termination, your right to use the Service ceases immediately. You may request data export within 30 days of termination.

13. Dispute Resolution

These Terms are governed by the laws of Indonesia. Any disputes arising from these Terms or your use of SwiftThumbnail shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of Indonesia, Jawa Tengah.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified via email at least 30 days in advance. Continued use of SwiftThumbnail after changes take effect constitutes acceptance of the modified Terms.
